Judge of the Kherson City Court Inna Khaidarova won a case against the High Qualification Commission of Judges, which doubted her ability to work in the appellate court.
This is stated in the corresponding decision of the Supreme Court of Ukraine.
In January of this year the High Qualification Commission of Judges declared Judge Khaidarova unable to work in the appellate instance and removed her from the competition for the position of judge of the Odesa Court of Appeal.
The Commission awarded the judge low scores for personal and social competence, and gave zero for professional ethics and integrity.
The basis for this was a negative conclusion by the Public Integrity Council.
Inna Khaidarova was accused of concealing a traffic fine in her 2016 declaration. However, the main complaint was her long-term residence in occupied Crimea.
However, the judge did not agree with this and appealed the decision.
Inna Khaidarova explained that in 2015 she left the Rovenky Court of Luhansk Oblast, where she was working at the time, due to hostilities. She was pregnant, did not receive a salary for six months and had no money to rent housing in territory controlled by Ukraine, so she temporarily stayed with relatives of the father of her child in Crimea.
The Supreme Court found the Commission’s conclusions regarding Inna Khaidarova’s personal and social competence unfounded and annulled the Commission’s decision.
Also the commission was ordered to reconsider the matter of confirming Khaidarova’s ability to administer justice in the appellate court.
Note that in January 2014 Khaidarova was appointed to the position of judge of the Rovenky City Court of Luhansk Oblast for a term of 5 years.
In April 2015 she was transferred within the five-year term to serve as a judge of the Suvorovskyi District Court of the city of Kherson, and later — to the Kherson City Court.
In 2019 the judge’s term expired, and she did not exercise judicial powers, and in 2021 Khaidarova spoke out against judicial reform.
In October of that same 2021 she filed a lawsuit asking the court to recognize the inaction of the President of Ukraine regarding the failure to issue a decree appointing her to the position of judge of the Kherson City Court within the prescribed period as unlawful.
The court found the president’s inaction unlawful and decided to oblige him to consider the submission of the High Council of Justice about appointing Khaidarova to the position of judge of the Kherson City Court.
In December 2025 she was appointed to the position of judge for an indefinite term.
