The Commercial Court of the Odesa Region ordered the Tyahynska community to return to the state 10 hectares of forest that had been converted into pastures.
This is stated in the relevant court decision.
The conflict over the plot began in 2020, when the Main Department of the StateGeoCadastre in Kherson Region, by its order, transferred to the Tyahynska community more than 4,400 hectares of state land.
Also included in this list was the plot that partially overlaps the lands of the Tokarivske forestry of SE “Kherson Forestry Enterprise” (now merged into SE “Oleshky Forestry and Hunting Enterprise”).
This territory contains forest stands, as confirmed by forest inventory data and the State Land Cadastre.
The court found that such lands should have been managed by the Kherson Regional State Administration, not the StateGeoCadastre. The regional authorities did not give any consent to change the forest’s designated purpose or to withdraw it.
Despite this, in June 2021 the state registrar of the Muzykivska village council officially registered communal ownership rights to this plot in favor of the Tyahynska village council.
As stated in the court document, representatives of the Tyahynska community did not attend the court hearings and did not submit any objections. The registration of the village council’s ownership right has now been canceled.
The plot will be removed from the land cadastre as agricultural land so that it will officially become state forest again.
