The Commercial Court opened proceedings on a lawsuit filed by the Beryslav District Prosecutor’s Office in the interests of the state regarding the termination of a contract for the construction of a household waste sorting complex in the Beryslav district of Kherson region.

The grounds for going to court were the contractor’s prolonged failure to fulfill its contractual obligations and unjustified extensions of the deadlines for performing the works.
Prosecutors established that in 2021 a contract worth over 24.4 million hryvnias was concluded between a state authority and a business entity for the construction of the relevant complex.
According to the terms of the contract, the works were to be completed by the end of December 2022. However, the contractor did not fulfill its obligations within the specified period.
“Subsequently, the business entity initiated the conclusion of a number of additional agreements to extend the deadlines for performing the works, while the implementation of such a contract became irrelevant due to the impossibility of its implementation under martial law and the lack of funding”, – the prosecutor’s office noted, stressing that the court proceedings are ongoing.
