The Commercial Court of Kyiv satisfied the claim of the Oleshky District Prosecutor’s Office in the interests of the state against a limited liability company to recover UAH 945 thousand to the local budget.

As the investigation established, when concluding in 2023 a contract for the construction of private residential houses in the village of Posad-Pokrovske of the Chornobaivska community, the amount of value added tax was unjustifiably included in the cost of the works. According to the Tax Code, such works are exempt from taxation because they were carried out under programs to restore housing destroyed as a result of hostilities.
Despite amendments to the contract, the funds paid as VAT were not returned to the budget. This provided grounds for the prosecutor’s office to bring the case to court.
