Kherson City Court denied the complaint filed by the attorney of the deputy of the Kherson Regional Council Serhiy Sorokunskyi, who is suspected of state treason, against the inaction of the regional prosecutor’s office, which did not enter information into the ЄРДР (Unified Register of Pre-Trial Investigations) based on a report of abuse of power by officials of the Muzykivska Rural Military Administration.
According to the court ruling, Sorokunskyi’s lawyer filed a complaint with the court about the inaction of prosecutors who did not initiate a pre-trial investigation into a fact that, in Sorokunskyi’s opinion, contained signs of a criminal offense under Part 2 of Article 364 of the Criminal Code of Ukraine (abuse of power or official position that caused grave consequences).
The statement, in particular, concerned the head of the Muzykivska RMA Ihor Pidhorodetskyi and other officials. They allegedly did not lease to the farming enterprise “SAPFIR-AGRO”, which belongs to Sorokunskyi’s family, five land plots within the community.
As alleged in the complaint, due to such inaction the local budget suffered a shortfall of more than UAH 2.1 million.
However, the court emphasized that there are not enough grounds to open proceedings under Article 364 of the Criminal Code of Ukraine.
“In the statement about the criminal offense… no circumstance is indicated that would indicate that Pidhorodetskyi committed actions… with the aim of obtaining any unlawful benefit. Thus, there are no grounds to enter information into the ЄРДР about the commission of a criminal offense, in particular under Article 364 of the Criminal Code of Ukraine,” – reads the ruling.
So the court dismissed the lawyer’s complaint.
Recall, on March 5 employees of the Security Service of Ukraine in the AR Crimea notified Serhiy Sorokunskyi of suspicion of aiding the aggressor state, detained him and conducted searches at his home.
The next day he was released on bail of 908 thousand hryvnias, however he received a new suspicion under Article 438 of the Criminal Code of Ukraine “War crimes”. This time the court decided to remand the suspect without the right to bail. Since then he has been in custody
At the end of July Sorokunskyi’s case was transferred to court.
