Kherson City Court, in absentia, found a native of Feodosia, a marine of the Russian army, Dmytro Nesterov, guilty of state treason, participation in Russia’s large-scale aggression, and the murder of civilians in Kherson Oblast.
This is stated in the court’s verdict.
According to the court, Nesterov, while on the temporarily occupied territory of the Autonomous Republic of Crimea, between 2014 and 2016 joined the armed forces of the Russian Federation. From 2016 he served in a marine unit of the Black Sea Fleet.
After the start of the full-scale invasion in 2022, the accused headed a unit of the Russian naval infantry and participated in combat operations in Kherson. In particular, from March to October 2022 he was in the areas of the settlements Pravdyne and Myrolyubivka, where he commanded subordinate servicemen.
The court found that Nesterov organized the unit’s activities aimed at suppressing the local population, conducting so-called filtration measures, and forcing people to cooperate with the occupation authorities.
His involvement in the killing of civilians in April 2022 in the village of Pravdyne has also been proven. According to the case materials, the victims were several men and an underage girl, after which the house was blown up.
The defendant’s guilt is corroborated by eyewitness testimony, identification results, expert examinations, and materials from social networks.
The court qualified Nesterov’s actions under the articles:
- part 1 of Article 111 of the Criminal Code of Ukraine in the form of 12 years’ imprisonment with confiscation of all property;
- part 2 of Article 111 of the Criminal Code of Ukraine in the form of life imprisonment with confiscation of all property;
- part 2 of Article 28, part 2 of Article 438 of the Criminal Code of Ukraine in the form of life imprisonment.
Ultimately, Dmytro Nesterov was sentenced to life imprisonment with confiscation of property. He will also be ordered to pay over 43 thousand hryvnias for the costs of conducting expert examinations.
