Oleshky District Prosecutor’s Office restored the state’s rights to a land plot of 18.86 ha of forestry land in the Dar’iv community of Kherson Raion through the court.

The court fully satisfied the claim, canceling the illegal state registration of the land, which in 2021 was unjustifiably reclassified into the category of agricultural land and transferred to communal ownership, the post says.
It was established that the plot actually belongs to the lands of the state forest fund, as evidenced by data from the State Land Cadastre, forest inventory materials and cartographic materials. The authorized bodies did not adopt any lawful decisions to withdraw these lands from the forest fund, change their intended purpose, or terminate the right of permanent use.
“Forest fund lands, by the nature of their purpose and legal regime, cannot be used for commercial agricultural production. Illegal changes to their category create serious risks for the preservation of forests and the environmental safety of the region. The court agreed with the prosecutor’s position and ruled in favor of the state”, – the prosecutor’s office reported.
