Construction works for the reconstruction of Kyselivska Gymnasium costing more than UAH 100 million have been officially suspended. The reason is a court process between the contractor and the State Audit Service of Ukraine.
MOST received this information in response to an information request.
According to the Chornobaivska village council, work is not being carried out due to open court proceedings challenging the DASU conclusion on the results of the procurement monitoring that took place in May of last year.
Recall, auditors demanded that the village council terminate the contract with the contractor LLC “Agency Sirius Group”, however the company did not agree with this decision and went to court with a lawsuit seeking to declare the DASU conclusion unlawful.
“The DASU conclusion is being challenged in court, proceedings in the case have been opened, and the Chornobaivska village council has been involved in the case as a third party. In view of the existence of open court proceedings and in order to uphold the principle of legal certainty, the performance of work under the concluded contract is temporarily suspended until the court decision in the relevant case comes into legal force”, — stated in the response
