The Commercial Court obliged the contracting company to return to the state budget more than UAH 1.8 million that it received during the construction of housing in the village of Posad-Pokrovske.
This was reported by the Kherson Regional Prosecutor’s Office.
This concerns the construction of residential buildings with public funds. During the payments the contractor was also paid value-added tax — more than UAH 1.8 million. However, under the law such works, if financed from the budget, are not subject to VAT.
Because of this, the prosecutor’s office filed a lawsuit. The court sided with it and obliged the company to return the money.
According to prosecutors, this is already the third similar ruling this year.
The village of Posad-Pokrovske is located in the territory of the Chornobaivska community of Kherson region. Most of the buildings in the village were destroyed during the hostilities on the right bank of the region in 2022.
In spring 2023 the settlement was included in a comprehensive reconstruction project. Reconstruction of the village is still ongoing. More than one billion hryvnias have already been spent on it.
